Payments made through Model Platform are processed using third-party payment-processing providers, which may include Stripe or other payment services made available through our checkout.
Payment processors may collect information such as your payment-card details, billing address, transaction amount, device information, and information necessary to authenticate and process your payment.
Model Platform generally does not store your complete payment-card number or card security code in its own systems when that information is collected directly by our payment processor.
We may receive limited payment-related information from the processor, such as confirmation that payment was successful, payment method type, transaction identifiers, billing information, and limited card information such as the last four digits.
Payment processors process information according to their own privacy policies and legal obligations.
4. How We Use Personal Information
We may use personal information for the following purposes:
Provide Our Services
We use information to operate ModelPlatform.com and the Design Studio; create comp cards, headshots, and other portfolio materials; generate digital files; prepare print-ready artwork; provide proofs; process orders; and deliver requested products and services.
Process and Fulfill Orders
We use order, design, billing, and shipping information to process transactions, produce your order, arrange printing, provide digital files, ship printed products, provide tracking information, manage reorders, and address fulfillment issues.
Maintain Designs and Order History
We may maintain completed designs, proofs, files, or information associated with previous orders for customer service, recordkeeping, troubleshooting, or to make future reorders easier.
Communicate With You
We may send order confirmations, receipts, production updates, shipping notifications, download information, customer-support responses, security notices, and other service-related communications.
These transactional communications are necessary to provide the services you request and are separate from promotional marketing communications.
Improve Model Platform
We may analyze how customers and visitors use our website, Design Studio, checkout, and other features to improve usability, reliability, performance, templates, products, services, and customer experience.
Protect Model Platform and Our Customers
We may use information to detect, investigate, and prevent fraud, unauthorized transactions, security incidents, misuse, intellectual-property violations, illegal activity, and violations of our Terms of Service.
Comply With Legal Obligations
We may process information when necessary to maintain business and tax records, respond to lawful requests, enforce agreements, resolve disputes, establish or defend legal claims, and comply with applicable laws and regulations.
Marketing and Promotions
Where permitted by law, we may use your contact information to send newsletters, modeling or acting resources, portfolio tips, product announcements, special offers, and other promotional communications.
You may unsubscribe from marketing emails at any time using the unsubscribe option in the message or by contacting us.
Unsubscribing from promotional email does not prevent us from sending transactional communications about an order or service you requested.
5. Photos, Résumés, Designs, and Customer-Submitted Content
Because Model Platform provides portfolio-design and printing services, customer-uploaded content is an important part of our service.
We may use your uploaded photographs, résumés, artwork, logos, measurements, contact information, and other submitted materials as reasonably necessary to:
- Operate the Design Studio;
- Create previews and proofs;
- Generate digital products;
- Prepare files for professional printing;
- Fulfill and ship orders;
- Perform requested design, editing, or retouching services;
- Provide customer support;
- Troubleshoot design or production problems; and
- Facilitate reorders when applicable.
Public Display of Customer Work
Submitting a photograph or design for printing does not, by itself, give Model Platform permission to publicly publish that material for advertising or promotional purposes.
If we wish to feature your comp card, headshot, photograph, testimonial, or other customer work in a gallery, portfolio, social-media post, advertisement, or promotional material, we will obtain appropriate permission or otherwise ensure that we have the legal right to use it.
When completed comp cards are displayed publicly as examples, we may remove or obscure personal contact information to help protect the individual’s privacy.
Artificial Intelligence and Uploaded Content
Model Platform does not sell customer photographs, résumés, or design files for use in training third-party or general-purpose artificial-intelligence models.
We may use software-assisted image processing, design, printing, quality-control, or production technologies when necessary to provide a service you request.
6. How We Disclose Personal Information
We do not disclose personal information indiscriminately. We may provide information to third parties when reasonably necessary to operate our business and provide your order.
Website and Technology Providers
We may use website hosting providers, WordPress and WooCommerce-related technology providers, cloud services, database providers, email systems, security services, software vendors, and other technology providers.
These providers may process information as necessary to perform services for us.
Payment Processors
We disclose transaction and billing information to payment processors as necessary to authorize, process, refund, or investigate payments.
Printing and Production Partners
When you order printed materials, we may provide printing and production vendors with the files and information necessary to manufacture your order.
This may include photographs, completed comp-card or headshot designs, print specifications, quantities, finishes, order identifiers, and information necessary for fulfillment.
Shipping and Delivery Providers
We may provide your name, shipping address, telephone number, email address, order information, and related delivery information to shipping carriers and fulfillment providers as necessary to deliver your order.
Analytics and Advertising Providers
We may use analytics, measurement, advertising, or similar technology providers to understand website performance, measure marketing effectiveness, and improve our services.
Depending on the technology used and your jurisdiction, certain disclosures involving cookies or online identifiers may be considered “sharing,” “targeted advertising,” or a “sale” under applicable privacy law even when no money is exchanged for your personal information.
Where applicable law provides an opt-out right, we will provide a method for exercising that right.
Professional Advisers
We may disclose information when reasonably necessary to attorneys, accountants, insurers, auditors, consultants, or other professional advisers.
Legal, Security, and Compliance Purposes
We may disclose information when we reasonably believe it is necessary to comply with applicable law, regulation, subpoena, court order, or other lawful process; investigate fraud or security incidents; protect the safety or rights of Model Platform, our users, or others; or establish, exercise, or defend legal claims.
Business Transactions
If Model Platform is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar business transaction, personal information may be disclosed or transferred as part of that transaction, subject to applicable law.
7. Sale and Sharing of Personal Information
Model Platform does not sell personal information for money as part of our ordinary business operations.
We also do not sell customer-uploaded photographs, résumés, model statistics, design files, or order files.
Some privacy laws define “sale” or “sharing” broadly enough to include certain uses of advertising cookies, tracking technologies, or disclosures of online identifiers to advertising or analytics providers.
Where those laws apply and our use of a technology qualifies as sale, sharing, or targeted advertising, you may have the right to opt out.
We do not knowingly sell or share for targeted advertising the personal information of individuals under the age at which additional consent is required by applicable law.
8. Cookies and Similar Technologies
ModelPlatform.com may use cookies and similar technologies to operate the website and Design Studio.
These technologies may include:
Essential Cookies
These help operate features such as shopping carts, checkout, account sessions, security, and website functionality.
Preference and Functionality Technologies
These may remember selections, settings, or other preferences.
Analytics Technologies
These help us understand how visitors use the website and identify areas for improvement.
Advertising or Measurement Technologies
Where used, these may help measure advertising campaigns or understand whether marketing results in visits or purchases.
You can generally control cookies through your browser settings.
Disabling essential cookies or browser storage may prevent portions of the website, Design Studio, cart, or checkout from functioning correctly.
Where applicable law requires consent before non-essential technologies are used, we will request that consent.
Where legally required and technically applicable, qualifying universal opt-out preference signals, such as Global Privacy Control, may be treated as a request to opt out of certain sale, sharing, or targeted-advertising activities.
9. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including providing services, maintaining appropriate business records, facilitating customer support or reorders, complying with legal obligations, resolving disputes, preventing fraud, and enforcing agreements.
Retention periods vary depending on the type of information.
For example:
- Order and transaction records may be retained as necessary for accounting, tax, payment, fraud-prevention, warranty, and legal purposes;
- Customer account information may be retained while an account remains active and for an appropriate period afterward;
- Customer-service communications may be maintained for support and business-record purposes;
- Incomplete, abandoned, canceled, or failed order information may be deleted or anonymized according to our retention practices;
- Design files, proofs, photographs, résumés, and completed artwork may be retained for fulfillment, support, troubleshooting, recordkeeping, or future reorders; and
- Some information may be retained longer when required by law, necessary to protect legal rights, or required to prevent fraud or abuse.
When information is no longer reasonably necessary, we may delete, anonymize, or deidentify it.
Backups may retain information for an additional limited period before being overwritten.
10. Data Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, disclosure, alteration, destruction, or misuse.
These safeguards may include encrypted connections, access restrictions, authentication controls, secure payment-processing technologies, backups, software updates, monitoring, and security practices appropriate to the nature of the information.
No website, network, database, electronic transmission, or storage system can be guaranteed to be completely secure. For that reason, we cannot guarantee absolute security.
If we become aware of a security incident involving personal information, we will respond in accordance with applicable law.
11. Your Privacy Choices and Rights
Depending on where you live and whether a particular law applies to Model Platform, you may have the right to:
- Confirm whether we process personal information about you;
- Request access to personal information we maintain about you;
- Request correction of inaccurate information;
- Request deletion of certain personal information;
- Obtain a portable copy of certain information;
- Withdraw consent where processing is based on consent;
- Opt out of certain targeted advertising;
- Opt out of certain sales or sharing of personal information;
- Limit certain uses of sensitive personal information where applicable;
- Object to or restrict certain processing where provided by law;
- Appeal our decision regarding a privacy request where applicable; and
- Exercise privacy rights without unlawful discrimination or retaliation.
These rights are subject to exceptions and limitations under applicable law. For example, we may need to retain transaction records for tax, accounting, fraud prevention, contractual, or legal purposes even after a deletion request.
How to Submit a Privacy Request
To submit a privacy request, contact us at:
hello@modelplatform.com
Please include “Privacy Request” in the subject line and describe the request you would like us to process.
We may need to verify your identity before fulfilling certain requests. Verification may involve confirming information associated with your account, order, or email address.
We will use information provided for verification only as reasonably necessary to verify and process the request.
Where permitted by law, an authorized agent may submit certain requests on your behalf. We may request proof that the agent has authority to act for you and may also verify your identity directly.
If we deny a request and applicable law gives you a right to appeal, you may submit an appeal by replying to our response or contacting us at the email address above.
12. California Privacy Rights
If the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”), applies to our processing of your information, California residents may have additional rights.
These may include the right to request information about:
- The categories of personal information we collected;
- The categories of sources from which the information was obtained;
- The purposes for collecting, using, selling, or sharing personal information;
- The categories of third parties to whom information was disclosed;
- The specific pieces of personal information we maintain about you; and
- Certain sales or sharing of personal information.
California residents may also have rights to request correction or deletion and to opt out of qualifying sales or sharing of personal information.
Model Platform will not discriminate against you because you exercise an applicable CCPA privacy right.
As described above, Model Platform does not sell personal information for money in the ordinary course of business.
If advertising or tracking technology used on our website constitutes “sharing” under the CCPA, California residents may exercise applicable opt-out rights through the methods we make available or through a qualifying universal opt-out preference signal where required.
13. Canadian Customers
Model Platform serves customers in Canada as well as the United States.
Where Canadian privacy law applies, we handle personal information consistent with applicable requirements concerning accountability, appropriate purposes, consent, limiting collection, limiting use and retention, accuracy, safeguards, openness, access, and correction.
You may contact us to request access to personal information we maintain about you or to request correction of inaccurate information, subject to applicable exceptions.
Personal information provided by Canadian customers may be transferred to or processed by Model Platform or service providers located in the United States or other jurisdictions. As a result, information may be subject to the laws and lawful access requirements of those jurisdictions.
Canadian customers who consent to receive commercial electronic communications may withdraw that consent using the unsubscribe mechanism provided in the message or by contacting us.
14. Children and Minor Talent
Model Platform’s services are intended to be purchased and managed by individuals who are at least 18 years old.
We recognize that parents, guardians, agencies, photographers, and other authorized adults may use Model Platform to create comp cards, headshots, or portfolio materials for minors.
A child under 18 should not independently create an account, place an order, or provide personal information to Model Platform.
If you submit photographs, measurements, names, résumé information, or other personal information relating to a minor, you represent that you are the minor’s parent or legal guardian or that you otherwise have appropriate authority and permission to provide that information and authorize its processing for the requested service.
Our services are not directed to children under 13, and we do not knowingly collect personal information directly from children under 13 without appropriate parental authorization.
If you believe a child has provided personal information directly to us without appropriate authorization, please contact hello@modelplatform.com so that we can review the situation and take appropriate action.
We do not knowingly sell or use children’s personal information for targeted advertising in violation of applicable law.
15. Third-Party Websites and Services
ModelPlatform.com may contain links to social-media platforms, industry resources, third-party websites, payment services, or other services that Model Platform does not operate.
This Privacy Policy does not govern the privacy practices of third parties.
We encourage you to review the privacy policy of any third-party website or service before providing personal information.
16. International Data Transfers
Model Platform is operated from the United States.
If you access our services from outside the United States, your information may be transferred to, stored in, or processed in the United States or another country where our service providers operate.
Privacy and data-protection laws in those jurisdictions may differ from those in your place of residence.
Where required, we use appropriate measures for international transfers of personal information.
17. Email and Marketing Preferences
If you subscribe to our newsletter or agree to receive promotional communications, we may send you information about Model Platform products, portfolio resources, promotions, announcements, or related services.
You may unsubscribe at any time using the unsubscribe link contained in our promotional emails or by contacting us.
We may continue to send non-promotional communications that are necessary to provide services you requested, such as receipts, order confirmations, proof notifications, shipping information, digital-download information, customer-support responses, or security notices.
18. Do Not Track and Universal Privacy Signals
Some browsers offer a legacy “Do Not Track” setting. Because there is not a uniform industry standard governing all Do Not Track signals, our website may not respond to traditional Do Not Track settings.
Separate browser-based universal opt-out mechanisms, such as Global Privacy Control, may have legal effect in certain jurisdictions.
Where applicable law requires us to recognize a qualifying universal opt-out preference signal, we will process that signal as required by law.
19. Changes to This Privacy Policy
We may update this Privacy Policy periodically to reflect changes to Model Platform, our technology, our business practices, or applicable law.
When we update the Privacy Policy, we will change the Last Updated date shown at the top of this page.
If an update materially changes how we use personal information, we may provide additional notice where required by law.
We encourage you to review this Privacy Policy periodically.
